1 · Who you are contracting with

The RASQI suite is provided by Roberto Alexandre Schopf, sole proprietor, trading as RASQIntelligence ("we", "us"), at Servidão Luxemburgo 375, Joinville, Santa Catarina, Brazil, CEP 89202-315. By buying a licence or using the products, you agree to these terms.

Payments are processed by Paddle acting as Merchant of Record. Paddle is the seller of record for your purchase, and its own buyer terms apply to the payment transaction.

2 · What the licence gives you

A RASQI licence grants one named user, for one year from purchase, a non-exclusive, non-transferable right to use all four products in the suite: the Line Simulator, 6Sigma Studio, the Industrial Investment Analyzer and the Manufacturing Project Manager.

Included for the licence period: every update we release, and support by e-mail. You may use the products for your employer's commercial work and for client work you perform.

3 · What the licence does not give you

• Sharing credentials with other people, or using one licence to serve several users in turn.
• Reselling, sublicensing, renting or offering the products as a service to third parties.
• Copying, decompiling, reverse-engineering or extracting the calculation engines, or attempting to reach code that is deliberately kept on the server.
• Using the products to build a competing simulator or analysis tool.

We keep all intellectual property in the software, the engines, the documentation and the brand. You keep everything you create with it — your line models, business cases, projects and reports are yours, and we hold no copy of them.

4 · Free month

The free month is the real software, limited as described on the pricing page. It carries no obligation to buy, and we ask for no card to start it. We may end or change it at any time; doing so never affects a licence already paid for.

5 · Beta

The suite is currently in beta, and the site says so. The engines and reports are in daily use and validated, but the interface, the languages and the licensing are still moving. Beta means features may change between releases; it does not mean results are provisional.

6 · Availability

The products are delivered over the internet and depend on it. The Line Simulator computes on a server, so a stable connection is required — the Capabilities page states what your connection needs, measured rather than estimated. We aim to keep the service available continuously but do not guarantee uninterrupted operation, and we may take it down for maintenance.

7 · What the software is — and what it is not

By using the products you acknowledge three things, and they are the conditions under which any output of ours is meant to be used:

1. The output depends on inputs you supply and control. Cycle times, loss rates, costs, margins and demand come from you. A model fed a wrong number returns a confident wrong answer, and no software can detect that the number was wrong — only that it was possible.
2. A result is a support for a decision, never the decision. Every figure must be reviewed by someone competent in the field it belongs to — process or industrial engineering for capacity and flow, your finance function for a business case, the qualified professional who signs the project for anything engineered, and your own safety and compliance function for anything normative.
3. We do not warrant the effectiveness of actions taken from an output. Whether a change delivers the modelled gain depends on execution, on conditions in your plant, and on the accuracy of what was entered — all of which are outside our knowledge and outside our control.

This is not us stepping back from the quality of the software: the engines are validated against closed-form theory and every screen states the assumption behind its number. It is the boundary between a model and a plant, and it does not move because a tool is good.

8 · Warranties and liability

We provide the products with reasonable skill and care, and we correct defects we can reproduce. Beyond that, and to the extent the law allows, the products are provided as they are, without a warranty that they will fit a particular purpose or that any specific result will follow from using them.

To the extent the law allows, our total liability arising out of or in connection with the products is limited to the amount you paid for the licence in the twelve months before the claim. We are not liable for lost profit, lost production, lost savings, or for any decision taken on the basis of a model's output.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

9 · Suspension

We may suspend or end a licence, without refund, if it is used in a way section 3 forbids. Where the breach is capable of being fixed, we will say what it is and give you a chance to fix it first.

10 · Price and renewal

Prices are shown on the pricing page in US dollars. Taxes for your country are calculated and charged at checkout by Paddle. A licence renews annually at the price in force at renewal; we notify you before charging, and you may cancel at any time. Refunds are covered by the Refund Policy.

11 · Your data

How we handle personal data is set out in the Privacy Policy. In short: your engineering and financial data stays on your machine, and we do not hold a copy of it.

12 · Changes to these terms

We may update these terms. If a change materially reduces what you get, we will tell licence holders by e-mail before it takes effect, and it will not apply retroactively to a licence period already paid for.

13 · Governing law

These terms are governed by the laws of Brazil, and disputes are subject to the courts of that jurisdiction — without depriving you of the protection of mandatory rules of the country where you live.
